Due to the lack of clear and direct legislation specific to biosafety of living modified organisms in Iraq can provides an adequate level of protection in the field use of living modified organisms resulting from modern biotechnology that may have adverse effects on the conservation and sustainable use of biological diversity, taking into account risk to human health, with a special focusing on transboundary transport. So that a legislation was drafted in this regard through Formation of a drafting committee to prepare the legislation on biosafety of living modified organisms (LMOs) and its products through studying of a number of legislations in this field like the Algerian, Yemeni, Iranian, Syrian, Jordanian and Libyan laws.
The legislation draft Included (22) article addressed the content of the legal text of the Cartagena Protocol in terms of transport and deliberation, handling and use of living modified organism.
After finalizing the draft by a sub-Committee, which was formed for drafting the law, it was presented to the members of main committee for review by their ministries, also presented to a number of the relevant authorities for their review. Then, it has been submitted to the governmental institutions, which are responsible on reviewing, approving and issuing the national legislations in Iraq.
Finally, the biosafety legislation has been approved and entered into force according to the Council of Ministers’ decree No. 102 in 2015, and issued/published in the Iraqi gazette.
